Terms of Service

These Terms of Service ("Terms") are an agreement between you and PanBuddha Digital Solutions Limited (British Columbia, Canada; "we," "us") governing your use of the Villagely website and mobile apps (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to create an account. The Service is for parents and guardians; children do not create or use accounts. By using the Service you confirm you meet these requirements.
2. The Service
Villagely helps parent groups organize events, RSVPs, polls, reviews, a private family directory, and curated local kids' activity suggestions. Features may change over time. AI-generated activity suggestions are provided for convenience and information only — you are responsible for deciding what is appropriate and safe for your family.
3. Your account
You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
4. Acceptable use
- Use the Service lawfully and respectfully; no harassment, hate, threats, or unlawful content.
- Do not post personal information about other people's children, or anyone, without the right to do so.
- Do not attempt to access data or groups you are not a member of, or to disrupt or reverse-engineer the Service.
- Do not use the Service to spam, scrape, or for any commercial purpose we have not authorized.
5. Your content
You keep ownership of the content you submit (profiles, photos, events, messages, reviews). You grant us a limited license to host, store, and display that content solely to operate the Service for you and your group. You are responsible for your content and confirm you have the right to share it — including that any photo or information you add about a child relates to your own child, or that you have the necessary permission.
6. Payments and subscriptions
Some features may require payment. Payments are processed by Stripe; by purchasing you also agree to Stripe's terms. Subscriptions renew until cancelled; you can cancel at any time from your profile (Profile → Subscription → Cancel) and your access continues until the end of the current billing period. Your first paid month is covered by a 30-day money-back guarantee — email admin@panbuddha.ca for the refund. Beyond that, except where required by law, payments are non-refundable. Prices and features may change with notice.
7. Third-party services
The Service relies on third-party providers (including Supabase, Brevo, Stripe, and a video provider for optional live streaming). Your use of those features may be subject to the providers' terms. We are not responsible for third-party services.
8. Termination
You may stop using the Service and delete your account at any time (Profile → Delete account). We may suspend or terminate access if you violate these Terms or to protect the Service or its users.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind to the extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or that any suggestion or information is accurate or suitable for your circumstances. You are solely responsible for the safety and supervision of your children at any activity or event.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us (if any) in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your content or your misuse of the Service, to the extent permitted by law.
12. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in British Columbia have jurisdiction, subject to any mandatory consumer-protection rights you have in your place of residence.
13. Changes
We may update these Terms as the Service evolves. We'll revise the "last updated" date above and, for material changes, notify members in-app. Continued use after changes means you accept them.
